Terms of Service

1. Acceptance of Terms

By accessing or using Powerfolio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Powerfolio is a platform that allows users to upload, visualize, and share Power Apps Canvas Apps and Power Automate Flows. The Service provides tools to create portfolio pages, manage projects, and showcase work to the community.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. User Content and Conduct

4.1 User Content

You retain ownership of any content you upload, post, or display on or through the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

4.2 Prohibited Content

You agree not to upload, post, or transmit any User Content that:

  • Violates any applicable law or regulation
  • Infringes upon the intellectual property rights of others
  • Contains malicious code, viruses, or harmful components
  • Is defamatory, harassing, abusive, or threatening
  • Contains sensitive personal information of others without consent
  • Is spam, fraudulent, or misleading

4.3 Content Moderation

We reserve the right to remove, edit, or refuse to display any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate.

5. Subscription and Payment

5.1 Subscription Plans

The Service may offer subscription plans with different features and pricing. We reserve the right to modify subscription plans, features, and pricing at any time with reasonable notice.

5.2 Payment Terms

Subscription fees are billed in advance on a recurring basis. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until the end of the billing period.

6. Intellectual Property

6.1 Service Ownership

The Service, including its original content, features, and functionality, is owned by Powerfolio and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, subject to your compliance with these Terms.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit any harmful or malicious code
  • Impersonate any person or entity or misrepresent your affiliation

8. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us or using account deletion features.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Powerfolio and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Powerfolio operates, without regard to its conflict of law provisions.
